Despite same-sex marriage being legal in all 50 U.S. states, members of the LGBTQ+ community are still facing discrimination and obstacles in their way. No one wants to feel like an outlier in any aspect of their lives, including the workplace, which is why it’s important to call out discrimination when you see it. 

Title VII of the Civil Rights Act protects all individuals from discrimination due to sex, but there is no federal law explicitly stating that this extends to LGBTQ+ identity. LGBTQ+ workplace issues fall into two categories: overt discrimination and subtle issues that exist in a workplace’s social dynamics.

Both kinds of discrimination can add to an LGBTQ+ employee’s sense of not fitting in, feeling harassed, and more, which can lead employees to look for work elsewhere.

LGBT Workplace Issues That Are Still Prevalent

Employment Discrimination Remains

A major issue that LGBTQ+ workers have faced is employment discrimination.

Employment discrimination laws define discriminatory acts as follows:

“Discriminatory practices include bias in hiring, promotion, job assignment, termination, compensation, retaliation, and various types of harassment.”

This legislation refers to one’s biological sex, but many in the LGBTQ+ community feel it should include discrimination due to gender norms. For example, when seeking a job, transgender candidates have lost job opportunities because their hair or dress style didn’t conform to gender stereotypes in a given workplace. In addition to a lack of inclusion in federal legislation, LGBTQ+ workers face a lack of legal protection, depending on what state they live in.

In the United States, 22 states, 3 territories, and Washington, D.C., have legislation prohibiting discrimination for private and public employees due to sexual orientation and gender identity. Other states have legislation, but often only for public employees.

Wage Gap Exists Between LGBT and Non-LGBT Workers

The Equal Pay Act of 1963 prohibits sex discrimination when an employer pays wages. However, much like employment discrimination laws, this law does not extend to discrimination based upon gender identity or sexuality. Accordingly, a wage gap exists between LGBTQ+ and non-LGBTQ+ employees. 

Transgender employees only a few years ago reported that they make 68 cents for every dollar a cisgender individual makes. This has led to some extreme levels of poverty for many transgender employees who must change jobs frequently due to pay, harassment, and discrimination. 

Studies have shown that transgender, non-binary, and LGBTQ+ people of color earn even less than others in the community. In addition, LGBTQ+ workers face challenges when it comes to job promotions

Also, while men in the LGBTQ+ community make 96 cents per dollar, women earn 87 cents

The wage gap exists to an astonishing level for LGBTQ+ individuals, and it can be debilitating. Living below the poverty line is all too common for employees who are going above and beyond. 

Workplace Acceptance Has Far to Go

In the workplace, an important part of company culture is how employees interact with each other. The social dynamics of a workplace help create its unique culture and environment. Some companies have taken an active role in supporting LGBTQ+ staff with initiatives that prioritize their LGBTQ+ employees. However, many companies do not offer any kind of unique LGBTQ+ support for employees. Other aspects of workplace dynamics that negatively impact an LGBT employee include how welcoming company culture is.

According to the Williams Institute, 46% of LGBTQ+ employees are not out to their supervisor, and 21% are not out to any coworkers. Employees who came out to a few coworkers or their supervisor were reportedly three times more likely to experience discrimination, and twice as likely to report harassment. 

Unfortunately, discussion of LGBTQ+ identity is seen as taboo in the workplace, more so than it was a year ago. A recent poll reported that only 17% of respondents felt comfortable talking about gender identity and sexual orientation. 50% of survey respondents said that they don’t feel LGBTQ+ identity should be discussed in the workplace at all.

With double standards like this existing in the workplace, LGBTQ+ employees feel uncertain about how open they can be about their identity. This uncertainty can lead to an employee feeling so uncomfortable that they leave the job.

A great company for LGBTQ+ employees has non-discrimination policies in place that explicitly prohibit discrimination based on sexual orientation and gender identity.
